RE: Cover-up of corrupt public contracting at the Malibu
Pier
Dear Mr. Carroll,
It was a pleasure meeting you this evening in front of
the drug store and you taking the time to sign my Petition
requesting the U.S. Congress order a Grand Jury investigation
into the public contracting fraud regarding the Malibu Pier.
Per our conversation, I have summarized the key points
in regard to this matter.
u Richard J. Riordin
L.A's ex mayor has used his influence to obtain illegitimately
the leases at both the Malibu Pier for 20 years, and the
lease at Gladstones on Will Rodgers Beach. Riordin's group
was the sole bidder and it is widely known that it was "fixed".
u Renovation of
the Malibu Pier to take one year has now taken six years
and is far from completion, and work has shut down.
u Malibu Pier closing
to the public at the shore line in January 1995, and Alices
restaurant being forced to close it's doors in January 1997
with the entire pier being closed is now the tenth summer
with the pier dissembled, it is obvious the corruption is
now widely known.
u There were no
duly authorized contracts signed by any contracting entities
doing work on the pier.
u Superior Gunite
Inc., Fibrwrap Construction Inc., DCA Drilling and Construction,
Halco Service Corp. (Halco Electric) all falsified Stop
Notices for claims for payment.
u Not one contracting
entity sent the required 20 day notice to the awarding agency,
bonding company, and the general contractor.
u Superior Gunite
and DCA Drilling and Construction are not duly licensed
for pile driving and neither knew what they were doing.
u Illegal substitutions
under the Unfair Practices Act in public contracting, Superior
Gunite illegally substituted for listed contractor K.D.
Home for beam replacement, DCA Drilling illegally substituted
for Superior Gunite for pile driving, Fibrwrap Construction
illegally substituted for Fyfe and Associates for the wrapping
of the piling, Accent Builders and Superior Gunite illegally
substituted for Vector Three Environmental for lead based
removal.
u Superior Gunite
Inc., Accent Builders Inc, DCA Drilling and Construction
Inc., Fibrwrap Construction Inc., all falsified their payroll
records by charging the state for Saturday work when no
such workmen were on the project, falsifying time and a
half payroll and not paying the required prevailing wage
rates.
u Superior Gunite
Inc. and DCA Drilling and Construction falsifying the depth
the piles are driven into the sand to reach the bedrock
thereby falsely extending the length of the piles to pad
the payments.
u Fyfe and Associates
writing a false sole source specification for the state
and then switching Fyfe an Associates Inc. for Fibrwrap
Construction Inc. The ICBO report number was falsified,
the testing of daily samples by an independent laboratory
was not done, the independent inspection by a deputy inspector
of the shelf life of the materials, the mixing of the epoxies,
the saturation of the fiberglass cloth (this fiberglass
was illegally substituted for the required carbon fiber)
was not done.
u Fiberwrap was
illegally paid " to repair their own defective and
falsified work which was and continues to emit the cancer
causing chemical creosote into the sand and ocean.
u Sheriff's Department
caused an unlawful arrest for documenting the defective
and falsified work of Fyfe and Associates and Fibrwrap Construction
Inc. with the District Attorney trying to oppress the disclosure
of the fraudulent work via a malicious prosecution for vandalism
because of the documentation of the defective work.
Enclosed is the Petition requesting the 108th United States
Congress to order a Grand Jury to investigate the wrongdoing
and cover-up of the corrupt public contracting at the Malibu
Pier in Malibu.
